General Terms and Conditions Casa Lux Rentals

Article 1: Definitions
• Landlord: Casa Lux Rentals; a company that rents holiday accommodations.
• Tenant: The person who rents a holiday accommodation.
• Accommodation: The holiday accommodation that is rented, including all associated facilities.
• Rental agreement: The agreement between the landlord and the tenant for the rental of an accommodation.
• Booking costs: The costs that the tenant pays for reserving an accommodation.
• Deposit: The amount that the tenant pays as security for any damage.

Article 2: Reservation and Payment
• Reservations can be made online, by telephone or by e-mail.
• A reservation is only final after confirmation by the landlord and payment of the deposit.
• The deposit depends on the chosen rate plan
• If the payment is not made on time, the landlord has the right to cancel the reservation.
• The stated prices include VAT, unless stated otherwise.

Article 3: Cancellation
• Cancellation by the tenant must be communicated in writing (by e-mail).
• The cancellation conditions depend on the selected rate plan.
• The landlord has the right to cancel the rental agreement in the event of force majeure. In that case, the rent already paid will be refunded.
• The landlord reserves the right to offer equivalent accommodation if the reserved accommodation is not available due to unforeseen circumstances.

Article 4: Use of the Accommodation
• The tenant must use the accommodation as a good family man.
• It is not permitted to use the accommodation for purposes other than holiday accommodation.
• The maximum number of people that may stay in the accommodation is the number specified when booking.
• Pets are allowed, unless otherwise stated in the description of the accommodation.
• Smoking is not permitted in the accommodation, unless otherwise stated in the description of the accommodation.
• The tenant is responsible for any damage to the accommodation and its inventory. • The tenant must adhere to the house rules that are present in the accommodation.

Article 5: Deposit
• The tenant does not have to pay a deposit upon arrival
• The tenant agrees that, if damage has been suffered, this will be irrevocably paid for by bank transfer or agrees that the landlord will charge the credit card for the damage suffered.

Article 6: Liability
• The landlord is not liable for personal injury or damage to the tenant’s property.
• The tenant is liable for all damage caused to the accommodation by him or his fellow travelers.
• The landlord is not liable for damage caused by force majeure.

Article 7: Complaints
• Complaints must be reported to the landlord immediately after they are discovered.
• The landlord will make every effort to resolve complaints as soon as possible.

Article 8: Applicable Law
• Spanish law applies to this rental agreement.
• Disputes will be submitted to the competent court in Benitachell.
